Block Your Trademark from .xxx Adult Websites

You may have heard that the new top-level domain .xxx is about to be launched, aimed for adult content.

It is important to know that it will be possible for anyone to register any name or trademark under the new top-level domain. This poses a huge risk for trademark owners, in particular as many adult content providers will not shy away from using trademarks to attract visitors to their websites. For this reason, a process has been introduced where trademark owners can block its trademarks from being used under the .xxx top-level domain. Valea strongly recommends trademarks owners to take this opportunity.

The application to block the trademark from .xxx registration must be filed within the so-called “Sunrise B”-period, lasting from September 7, 2011, until October 28, 2011.

A few criteria must be fulfilled in order to block a trademark, for example that the trademark must be registered before September 1, 2011. The blocking will be anonymous and the name of the blocking party will not be visible in public registration databases (WHO IS records).
